An employee of a national system employer is covered by the Fair Work Act 2009 and all other employees and employers will be covered by Western Australian State Statutes such as the Industrial Relations Act 2009, Minimum Conditions of Employment Act 1993 and various other Acts and Awards.
If you are an employer....
You may need to seek assistance to enable you to determine whether you are a national system employer or whether you are covered by the State system. This is important because each system can impact on your current employment arrangements, arrangements with new employees and the rights and obligations you have when disciplining or terminating an employee.
If you are an employee...
You may also need assistance if you are about to negotiate an employment contract or if you have recently been terminated or made redundant. Both the Fair Work Act and the State Acts provide protections for employees but there are sometimes strict timeframes to adhere to.
