There has as yet been no authoritative determination of the question whether an owner’s decision to sell a defectively constructed home without first having remedied the defects will preclude subsequent recovery of compensation with respect to those defects.

People often get surprised when we tell them that they can’t automatically recover compensation from a builder just because that builder has departed from the plans and specifications in the building contract. They get even more surprised when we tell them that departures from applicable Australian Standards and Building Codes are still not enough to get you an award of compensation.

When a sum of money is being claimed in a court, it is usual to claim interest on that sum. But not everyone who has a claim for an amount of money, be it for compensation, restitution or a debt, is entitled as of right to claim interest.
