On this Australia Day session, Bruce Havilah talks to Howard about an infamous Australian George Crossley who was a lawyer transported to Australia around 1800 and made his mark on early settlers by completing his sentence and opening practice in New South Wales to go on to represent three governors in his chequored history. The issue of changing will after the onset of dementia is examined as well as the capacity to donate a power of attorney. Also discussed is the opportunity to challenge a person acting under a power of attorney in event has been abuse of that power. The issue of a reverse mortgage is discussed in the impact on the will of a testator wishing to leave their property to a beneficiary.
