Timing in Building Contracts - Don’t leave it until its too late!

Timing can be crucial to home building contracts.  There are time periods for just about everything: getting the house built, getting defective materials or workmanship issues fixed and making sure maintenance checks are done so you don’t void your builder’s warranty.  To complicate things even further, different time periods start to run for different things on different dates.  Sometimes, time is counted in working days; other times, in calendar days.  It can all get very confusing!

But…the consequences of missing a date and could affect your rights against the builder in a big way.

Havilah Legal will help you work out what needs to be done when…and make sure you don’t lose your rights as a result of bad timing.

Your standard HIA home building contract can be a minefield for the inexperienced.  Come and see us to expose some of the more common traps lurking in most home building contracts and the best ways to avoid them.

The best time to do this is before you sign the bottom line: otherwise, you may find yourself trapped in a situation that you cannot lawfully get out of.  For example, in some instances, a builder can raise the price without your consent and then sue you for breaching the contract if you don’t pay the extra money?

Are you prepared to act alone and risk doing something which either voids the builder’s warranty or removes the builder’s obligation to fix defects in workmanship or materials?

Let us help.
